Terms and Conditions for Leaf Cleanup Services
1. Acceptance of Estimate By accepting this estimate, the customer agrees to the terms and conditions outlined herein. Acceptance of this estimate can be made by signing this document, confirming via email, or verbally agreeing to the terms prior to the commencement of work.
2. Scope of Work This estimate covers leaf cleanup services, which generally include:
Raking, gathering, and removing fallen leaves from the specified areas (lawns, gardens, driveways, sidewalks, etc.).
Bagging or hauling leaves away (as per the scope defined in the estimate).
Removal of leaves from flower beds, patios, and other hardscapes (if included in the estimate).
Minor trimming of plants or bushes, if necessary, to access areas covered by leaves (if specified in the estimate).
Exclusions:
The following services are not included in the standard leaf cleanup unless specifically agreed upon and outlined in the estimate:
Removal of sticks, branches, or other debris.
Lawn mowing or aeration.
Clean-up of large, stubborn debris such as sod, rocks, or trash.
Removal of leaves from areas inaccessible to our crew (e.g., behind fences, in heavily wooded or locked areas).
3. Frequency of Service Leaf cleanup services are typically performed on a one-time or seasonal basis (e.g., autumn cleanup). Customers may request ongoing or multiple visits during the leaf fall season, subject to availability and additional charges.
4. Pricing and Payment Terms
Service Pricing: The price for leaf cleanup is based on the size of the lawn, the extent of the cleanup required, and the amount of debris to be cleared. The customer will be informed of the total cost in the provided estimate.
Payment Terms: Payment is due upon completion of the service unless a different payment schedule has been agreed upon. Accepted payment methods include cash, check, or credit card.
Late Payments: Invoices not paid within 7 days of service completion may incur a late fee of 10% per month.
Additional Charges: If the scope of work changes or additional services are requested on the job site (e.g., more extensive leaf accumulation than originally estimated), the customer will be notified of the additional cost and must approve before the work proceeds.
5. Service Schedule Leaf cleanup services will be performed on the scheduled date(s) specified in the estimate. If weather conditions (rain, snow, etc.) delay the service, the company will contact the customer to reschedule. If rescheduling is not possible due to adverse weather, the service will be completed as soon as conditions allow.
6. Customer Responsibilities
Access to Property: The customer must ensure that our crew has unobstructed access to all areas where leaf cleanup is required. Any gates, fences, or other barriers should be unlocked, and pets should be secured indoors or in a safe area during the cleanup process.
Obstructions: It is the customer’s responsibility to remove large obstacles, such as toys, furniture, or garden equipment, from areas to be cleaned up. Failure to remove such items may delay the service, and additional charges may apply.
Lawn Condition: If there are significant lawn issues (e.g., uneven terrain, hidden sprinkler systems), the customer should inform the company before the work begins. The company is not liable for damages to hidden or undisclosed features (e.g., sprinkler heads, drainage systems).
7. Equipment and Property Damage While every effort is made to avoid damaging property, the company is not responsible for any pre-existing conditions or unforeseen issues that arise during the service. The company will not be held liable for damages to underground utilities, sprinkler systems, or other hidden items unless disclosed prior to the service. Customers should ensure that all underground utilities are properly marked before work commences.
8. Cancellation and Rescheduling
Cancellations: If the customer needs to cancel or reschedule the leaf cleanup service, a minimum of 24 hours' notice is required to avoid a cancellation fee of $75. If the customer fails to provide proper notice, a fee may be charged, or the service will be billed at the scheduled rate.
Weather Delays: If weather conditions prevent the completion of the service, the company will reschedule the cleanup at the next available date and notify the customer accordingly.
9. Service Guarantee The company strives to ensure customer satisfaction with every service. If there are any issues with the quality of the leaf cleanup (e.g., missed areas, incomplete cleanup), the customer must notify the company within 24 hours of service completion. The company will make reasonable efforts to correct any deficiencies at no additional charge.
Note: The guarantee does not cover issues caused by factors beyond the company’s control, such as additional leaf accumulation after the service, weather-related damage, or areas that were inaccessible or unprepared.
10. Liability The company is not responsible for any damage to items or areas that were not disclosed by the customer prior to the service, including hidden objects or systems such as sprinkler heads, irrigation pipes, or other underground utilities. Customers are responsible for marking or identifying any potential hazards before service begins.
11. Property Condition The company will leave the property in a neat and tidy condition. However, the customer is responsible for ensuring that all lawn areas are free of excessive debris, rocks, or other materials that could interfere with the cleanup process. If additional time is required for debris removal, the customer will be informed, and additional charges may apply.
12. Termination of Service The customer or the company may terminate this agreement at any time with written notice. If the customer wishes to terminate services, notice must be given at least 7 days before the next scheduled service. The company may terminate service if payment is not received in a timely manner or if the customer fails to comply with their responsibilities outlined in these terms.
13. Changes to Terms These terms and conditions may be amended or updated at any time. The company will notify the customer of any significant changes to these terms, and the revised terms will apply to any services rendered after the update.
14. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of [state or region], without regard to its conflict of law provisions.
15. Dispute Resolution In the event of any disputes arising from these terms and conditions, the customer agrees to first attempt to resolve the matter through informal communication. If informal resolution is not possible, the dispute may be resolved through mediation or arbitration in accordance with local laws.
16. Force Majeure The company will not be held liable for failure to perform services due to events beyond its reasonable control, including but not limited to weather conditions, natural disasters, strikes, or government regulations.
17. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement This document constitutes the entire agreement between the customer and the company regarding leaf cleanup services. Any modifications or amendments must be made in writing and signed by both parties.
By accepting this estimate, the customer acknowledges that they have read, understood, and agreed to the terms and conditions outlined above.
