Terms and Conditions for Aeration and Overseeding
1. Acceptance of Estimate By accepting this estimate, the customer agrees to the terms and conditions outlined herein. Acceptance can be made through a signed agreement, verbal approval, or confirmation via email prior to the commencement of the service.
2. Scope of Work This estimate covers aeration and overseeding services, which typically include:
Aeration: Mechanical soil aeration to relieve soil compaction and improve water, nutrient, and oxygen penetration. This is done using core aerators that remove small plugs of soil from the lawn.
Overseeding: The process of spreading grass seed over the existing lawn to enhance lawn density, improve turf quality, and repair bare or thinning areas. The seed type will be chosen based on the customer’s preferences and the region's climate.
Fertilization: If included in the estimate, a balanced fertilizer will be applied after overseeding to promote seed germination and root development.
Exclusions:
The following services are not included in the standard aeration and overseeding estimate unless specifically mentioned:
Lawn mowing, edging, or other landscaping services.
Removal of existing debris or thatch buildup unless stated in the estimate.
Additional soil amendments, such as compost or lime, unless specifically requested.
3. Timing and Frequency of Service Aeration and overseeding services are typically performed in the fall or early spring, depending on the climate and grass type. The optimal timing for these services is essential for successful lawn improvement.
The customer will be notified in advance of the scheduled date(s) for service.
Services may need to be rescheduled due to weather delays (e.g., rain, extreme temperatures). If rescheduling is necessary, the company will contact the customer to set a new date.
4. Pricing and Payment Terms
Service Pricing: The price for aeration and overseeding services is based on the size of the lawn, the extent of the work, and any additional treatments (e.g., fertilization). The customer will be informed of the total cost in the estimate.
Payment Terms: A 50% deposit is due upon acceptance of the estimate. The remaining balance is due upon completion of the service. Accepted payment methods include cash, check, or credit card.
Late Payments: Invoices not paid within 7 days of service completion may incur a late fee of 10% per month.
Additional Charges: If the scope of work changes during service (e.g., larger lawn area, more extensive soil amendments), the customer will be notified of any additional costs before the work proceeds.
5. Service Conditions
Lawn Preparation: It is the customer’s responsibility to ensure that the lawn is free from debris (e.g., sticks, rocks, toys, garden tools) before the aeration and overseeding service. If large debris or obstructions are found, the company may charge additional fees or reschedule the service.
Irrigation: The customer is responsible for ensuring that the lawn is adequately watered before and after aeration and overseeding to promote seed germination and healthy growth. Lack of proper irrigation may result in poor seed establishment.
Optimal Lawn Condition: The company recommends performing aeration and overseeding on lawns that have moderate to heavy thatch buildup and compaction. If the lawn has severe issues (e.g., heavy infestation of weeds, bare patches larger than 50% of the lawn), the company will advise the customer of other possible treatments.
6. Customer Responsibilities
Access to Property: The customer must provide clear access to all lawn areas that require aeration and overseeding. Gates should be unlocked, and pets should be secured indoors or in a safe area during service.
Lawn Obstructions: The customer must remove all obstacles, including outdoor furniture, toys, and lawn ornaments, before the scheduled service. Failure to remove such items may result in delays or additional charges for moving them.
Notification of Special Conditions: If there are any hidden irrigation systems, sprinkler heads, or other obstacles that may interfere with the aeration process, the customer must inform the company in advance. The company will not be liable for damage to unmarked or undisclosed systems.
7. Equipment and Property Damage While the company takes every precaution to avoid damage, it is not responsible for any pre-existing conditions, including underground systems (sprinklers, pipes, wires) or landscaping features that are not properly marked. Customers should ensure that underground utilities are properly flagged or disclosed before service begins. The company is also not liable for any damage caused by heavy machinery to grass, landscaping, or hardscapes (e.g., sidewalks, patios) unless it is caused by negligence.
8. Service Guarantee The company strives for customer satisfaction. If there are concerns regarding the quality of the aeration or overseeding, the customer must notify the company within 7 days of service completion. The company will make reasonable efforts to resolve any issues, including reapplying seed or addressing any aeration issues.
Note: The guarantee does not cover issues arising from improper irrigation, extreme weather conditions, or lawn neglect after service completion.
9. Cancellation and Rescheduling
Cancellations: If the customer wishes to cancel or reschedule the service, a 48-hour notice is required to avoid a cancellation fee of $75.
Weather Delays: If weather conditions (e.g., rain or extreme heat) prevent the aeration and overseeding service from being completed, the company will reschedule the service as soon as possible. The customer will be notified of any changes to the schedule.
10. Liability The company is not responsible for any damage to hidden or undisclosed items (e.g., sprinkler heads, utility lines) or for issues resulting from improper lawn maintenance, such as poor irrigation or failure to follow post-service care instructions. The customer is responsible for ensuring all potential hazards or underground systems are marked before the service begins.
11. Termination of Service Either the customer or the company may terminate this agreement at any time with written notice. If the customer wishes to terminate services, notice must be given at least 7 days before the next scheduled service. The company may terminate service if payment is not received or if the customer fails to meet their obligations under these terms.
12. Changes to Terms These terms and conditions may be amended or updated from time to time. The company will notify the customer of any changes, and the updated terms will apply to any future services rendered after the update is communicated.
13. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of [state or region] without regard to its conflict of law provisions.
14. Dispute Resolution In the event of any dispute, the customer agrees to resolve the matter through mediation or arbitration before initiating any legal action.
15. Force Majeure The company will not be held liable for failure to perform services due to events beyond its reasonable control, including but not limited to weather conditions, natural disasters, or labor strikes.
16. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
17. Entire Agreement This document constitutes the entire agreement between the customer and the company for aeration and overseeding services. Any modifications or amendments must be made in writing and signed by both parties.
By accepting this estimate, the customer acknowledges that they have read, understood, and agreed to the terms and conditions outlined above.
