Terms and Conditions for Mulch Installation
1. Acceptance of Estimate By accepting this estimate, the customer acknowledges and agrees to the terms and conditions outlined herein. Acceptance may be provided by signing this estimate, confirming via email, or verbally agreeing to the terms prior to the commencement of work.
2. Scope of Work The scope of work for this estimate includes the delivery and installation of mulch in the specified garden beds or areas as outlined in the estimate. Any additional services, such as bed preparation, weed removal, or landscaping, are subject to additional charges and will be included in a revised estimate.
3. Mulch Type and Color The type, color, and quantity of mulch specified in the estimate are based on the customer’s selection. Any changes to the type or color of mulch after the estimate has been accepted may result in price adjustments. Changes must be communicated and approved in writing prior to installation.
4. Delivery and Installation The mulch will be delivered and installed on the date(s) specified in the estimate. Any delays due to weather, availability of materials, or other unforeseen circumstances may result in rescheduling. The customer will be notified of any changes.
5. Access to Property The customer is responsible for providing unobstructed access to all areas where mulch is to be installed. If gates, fences, or any other obstacles hinder access, the customer must ensure they are removed or made accessible before the scheduled workday.
6. Property Condition It is the customer’s responsibility to ensure that the garden beds or areas to be mulched are free of any existing debris, rocks, or other materials that may interfere with the installation process. If additional time or effort is required to prepare the site, additional charges may apply.
7. Pricing and Payment Terms The total cost for mulch installation, including materials, labor, and any additional services, is outlined in the estimate. A 50% deposit is due upon acceptance of the estimate, with the remaining balance due upon completion of the job. Payments can be made by cash, check, or credit card. If payment is not received within 7 days of completion, a late fee of 10% per month may be applied to the outstanding balance.
8. Estimate Validity This estimate is valid for a period of 30 days from the date issued. After this time, prices, availability of materials, and scheduling may be subject to change.
9. Weather Delays Work may be delayed due to inclement weather (e.g., heavy rain, snow, or extreme heat) that may affect the quality of the mulch installation. The company will reschedule work as needed and notify the customer of any changes.
10. Liability While we take care to protect your property during the course of the work, the company is not responsible for any pre-existing conditions, including but not limited to underground utilities, structures, or landscaping that may be damaged during installation. Customers should ensure that underground utilities are marked before work begins.
11. Warranty Mulch installation comes with a 1-year warranty on both the materials and installation. If there are any issues such as shifting mulch or improper coverage within the warranty period, the company will address these issues at no additional charge. This warranty does not cover damage caused by external factors such as weather, pests, or neglect.
12. Cancellations and Rescheduling If the customer wishes to cancel or reschedule the work, a 48-hour notice is required. Cancellations made with less than 48 hours’ notice may be subject to a cancellation fee equal to 20% of the estimated total. Rescheduled work is subject to availability.
13. Customer Responsibilities
Ensure that all pets, children, and personal belongings are kept at a safe distance from the work area.
Inform the company of any potential hazards or special considerations before the work begins (e.g., hidden irrigation systems, fragile plants, etc.).
The customer is responsible for ensuring proper irrigation and maintenance of the mulch after installation, as the company’s responsibility is limited to the initial installation.
14. Additional Work Any work not specified in this estimate, including but not limited to the removal of old mulch, bed preparation, trimming, or additional areas to be mulched, will be subject to an additional charge. A revised estimate or change order will be provided before such work is undertaken.
15. Dispute Resolution In the event of any dispute, the customer agrees to work with the company in good faith to resolve any issues amicably. If a dispute cannot be resolved through mutual agreement, the parties agree to pursue mediation or arbitration in accordance with local laws and regulations before any legal action is taken.
16. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of the state in which the services are provided.
17. Force Majeure The company will not be held liable for delays or failure to perform services due to causes beyond our reasonable control, including but not limited to acts of nature, governmental regulations, or strikes.
18. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement This estimate and the terms and conditions contained herein constitute the entire agreement between the company and the customer. Any modifications or amendments must be made in writing and signed by both parties.
