Terms and Conditions for Landscaping Services
1. Acceptance of Estimate By accepting this estimate, the customer agrees to the terms and conditions outlined herein. Acceptance can be made through a signed agreement, verbal confirmation, or written approval (e.g., email) before the commencement of services.
2. Scope of Work This estimate covers landscaping services as outlined in the proposal. These services may include, but are not limited to:
Design and Installation: Planning and installing new landscaping features, such as planting flowers, shrubs, trees, or other decorative elements(Landscape rock, mulch).
Pruning and Trimming: Trimming or cutting back overgrown shrubs, trees, and plants.
Soil Improvement: Aeration, fertilization, or soil amendments for better plant growth.
Any services not specifically listed in the estimate, such as pest control, tree removal, or large-scale demolition, are considered outside the scope and may require a separate agreement or additional charges.
3. Pricing and Payment Terms
Service Pricing: The price for landscaping services is based on the nature and extent of the work involved. A detailed breakdown of costs will be provided in the estimate, including labor, materials, equipment, and any other associated costs.
Payment Terms: A 50% deposit is due upon acceptance of the estimate. The remaining balance is due upon completion of the project or as outlined in a payment schedule.
Accepted Payment Methods: Payments may be made via check, credit card, or electronic transfer.
Late Payments: Any outstanding balances past 7 days from the invoice due date may incur a late fee of 10% per month.
Additional Charges: If additional work or materials are required during the course of the project, the customer will be notified of any changes to the cost before the work proceeds.
4. Service Schedule
The start and completion dates will be outlined in the estimate. The company will make reasonable efforts to adhere to the schedule, but timelines are subject to change due to weather conditions, supply delays, or unforeseen issues.
Weather Delays: If weather conditions (e.g., rain, extreme heat, snow) prevent work from being completed as scheduled, the company will notify the customer and reschedule the service as soon as possible.
5. Customer Responsibilities
Access to Property: The customer is responsible for ensuring that the service area is accessible. This includes clearing any obstacles or debris (e.g., lawn furniture, toys, garden tools) from the work area before the project begins.
Pets and Children: For safety reasons, pets and children should be kept away from the work area during landscaping activities.
Utility Marking: If applicable, the customer must notify the company of any underground utilities (e.g., gas, water, electricity) or irrigation systems on the property that may affect the work. The company will not be responsible for damages to unmarked utilities.
6. Equipment and Property Damage While every effort will be made to avoid damage, the company is not liable for any damage to existing landscape features, underground utilities, or structures (e.g., sprinkler systems, fences) unless specifically disclosed to the company prior to service. The customer is responsible for marking or identifying any potential hazards.
7. Changes in Scope of Work
If the customer requests changes to the scope of work after the estimate has been accepted, the company will provide a new estimate or price adjustment. The customer must approve any additional charges before changes are made.
If unforeseen issues arise during the course of work (e.g., hidden rocks, drainage issues), the company will inform the customer and propose solutions and costs for approval.
8. Service Guarantee The company strives for customer satisfaction and will make reasonable efforts to address any concerns. If the customer is not satisfied with the results of the landscaping services, they must notify the company within 7 days of completion. The company will attempt to resolve the issue, including making adjustments or redoing the work if necessary.
Limitations of Guarantee: The company is not responsible for issues arising from external factors such as weather, pests, lack of irrigation, or improper post-service maintenance.
9. Cancellation and Rescheduling
Cancellations: The customer may cancel or reschedule the service with 48 hours' notice. Cancellations made with less than 48 hours' notice may incur a cancellation fee of $200.
Weather-Related Rescheduling: If the service is delayed due to weather conditions, the company will reschedule the work and inform the customer of the new date.
10. Liability The company will not be held liable for damage to any existing conditions on the property (e.g., structures, utilities, or landscaping) that were not disclosed or properly marked before the service began. The company is not responsible for damage caused by extreme weather conditions, neglect, or improper maintenance by the customer after the completion of the work.
11. Termination of Service Either the customer or the company may terminate this agreement at any time with written notice. If the customer wishes to terminate the agreement, they must provide notice at least 7 days before the next scheduled service. In the event of termination, the customer will be responsible for payment of any completed work or materials already purchased.
12. Confidentiality The company will not disclose any confidential information related to the customer’s property or the landscaping services provided, except as required by law. Customer information will only be used for the purpose of providing services and invoicing.
13. Changes to Terms These terms and conditions may be updated or revised at any time. The customer will be notified of any significant changes, and the updated terms will apply to any services performed after the changes are communicated.
14. Governing Law These terms and conditions shall be governed by and construed in accordance with the laws of [state or region], without regard to its conflict of law provisions.
15. Dispute Resolution Any disputes arising from the terms and conditions of this agreement will first be addressed through mediation. If mediation does not resolve the issue, the dispute may be taken to arbitration in accordance with local laws.
16. Force Majeure The company will not be held liable for failure to perform services due to events beyond its reasonable control, including but not limited to extreme weather conditions, natural disasters, strikes, or government regulations.
17. Severability If any provision of these terms and conditions is found to be invalid or unenforceable, the remainder of the provisions will continue in full force and effect.
18. Entire Agreement This document represents the entire agreement between the customer and the company for landscaping services. Any modifications or amendments must be in writing and signed by both parties.
By accepting this estimate, the customer acknowledges that they have read, understood, and agree to the terms and conditions outlined above.
